Phillips Machine Service Inc. accused of not paying for goods it accepted

BECKLEY — A West Virginia corporation is suing Phillips Machine Service Inc., a West Virginia business, for alleged breach of contract.

Swanson Industries Inc. filed a complaint on May 23 in the Raleigh Circuit Court against the defendant through its wholly owned subsidiary, the Combs Group, alleging it failed to pay the plaintiff for goods the company allegedly agreed to purchase.

According to the complaint, the plaintiff alleges it suffered financial damages from not being paid and holds the defendant responsible for allegedly failing to pay for goods it received and accepted from the plaintiff.

The plaintiff seeks the amount of $12,178.33 plus continually accruing interest charge at the rate of 7 percent per annum, all legal fees and any other relief this court deems just. They are represented by John R. Keating of Amato Keating and Lessa, P.C. in Bethlehem, Pa.
