Mineral rights owners accuse oil, gas well operators of breaching lease

MOUNDSVILLE — Three Marshall County mineral rights joint owners are suing oil and gas wells operators, alleging breach of a lease agreement.

Fred B. Games, Mary V. Games and Vallie J. West filed a complaint May 25 in Marshall Circuit Court against Chesapeake Appalachia LLC and SWN Production Company LLC, alleging they failed to market oil and gas pursuant to the terms of the agreement.

According to the complaint, the defendants' actions have created a cloud upon the title of the plaintiffs' oil and gas rights and they have been forced to incur substantial costs and expenses and attorney fees. The plaintiffs allege the defendants attempted to extend the oil and gas leases through a delay in marketing payments when there were no oil and gas wells capable of production.

The plaintiffs seek trial by jury, declaratory judgment that the leases signed Dec. 5, 2008, are no longer valid and that the defendants have no valid claim of interest in the oil and gas rights, attorney fees, court costs and all other just and proper relief. They are represented by attorneys James G. Bordas Jr. and Jeremy M. McGraw of Bordas & Bordas PLLC in Moundsville.
