RIPLEY — A West Virginia man is suing the Scotts Company LLC and Wal-Mart Stores Inc. for allegedly taking insufficient measures to prevent injuries.

Larry Parsons filed a complaint on June 2 in the Jackson County Circuit Court, alleging that the defendants breached their duty to protect or warn plaintiff of a dangerous product.

According to the complaint, the plaintiff alleges that he was a patron at a Wal-Mart store in Ripley on June 4, 2015 when his forearm was lacerated by a blade embedded in a bag of Scotts Premium Topsoil. 

The plaintiff alleges that he suffered significant medical and hospital expenses for the treatment of his injuries. The plaintiff holds the defendants responsible for allegedly designing and manufacturing a defective bag of soil that made it unsafe for its intended use.

The plaintiff requests a trial by jury and seeks compensatory damages, attorney's fees, costs and such other just and proper relief. He is represented by Eric J. Holmes and Kevin C. Harris of Law Offices of Harris and Holmes PLLC in Ripley.
