WHEELING — A West Virginia corporation is suing Lesley J. Antonik, a tenant, for alleged breach of contract.
Action Gaming Inc. filed a complaint on June 8 in the Ohio County Circuit Court, alleging that the tenant breached her duty of good faith and fair dealing.
According to the complaint, the plaintiff alleges that it entered into a lease agreement with the defendant on March 1, 2015, with a one-year automatic renewal unless the defendant gave written notice of non-renewal. In September 2016, the defendant vacated the premises but failed to release a letter of intent not to renew, and her rentals accrued through Dec. 31, 2016 amounting to $22,000, less $9,000 from rentals paid.
The plaintiff holds the defendant responsible for allegedly failing to fulfill her obligations under the lease agreement.
The plaintiff requests a trial by jury and seeks judgment against defendant for damages in the amount of $13,000, interest, costs and fees. They are represented by Thomas R. Zimmerman of Zimmerman Law Offices in Morgantown.
