HUNTINGTON — A West Virginia corporation is suing Melissa Harmon, Shannon Diaz, Paul Marcum, Virgie Edgell, Steve Mahan, the unknown heirs of Jacaqueline C. Mahan, West Virginia-American Water Company and Chuch Zerkel for alleged violation of federal law.
AEP West Virginia Transmission Company Inc. filed a complaint on June 7 in Cabell Circuit Court, alleging that the defendants claim ownership of the area.
According to the complaint, the plaintiff alleges that the defendants, except for West Virginia-American Water Company, claim they own a portion of a property on which the plaintiff had planned to construct an improvement project. The plaintiff holds the defendants responsible for allegedly claiming interest to the contested area and barring the plaintiff from entering. The water company, however, owns land that the plaintiff claims that it needs for a construction project.
The plaintiff seeks grant an immediate right of entry in order for the construction to commence without delay and other relief as this court deems just. They are represented by Douglas C. McElwee and Chelsea E. Richmond of Robinson & McElwee PLLC in Charleston.
