BECKLEY — A Fairdale resident is suing restaurant operators, citing alleged insufficient measures were taken to prevent injuries.

Shirley M. Ashmore Stewart filed a complaint June 5 in Raleigh Circuit Court against Little General Store Inc., doing business as Burger King, and Burger King Corp., alleging they breached their duty to maintain the premises in a reasonably safe condition.

According to the complaint, the plaintiff alleges that on June 18, 2015, she was walking into the entrance of Burger King in Beckley when she tripped and fell over a furled mat on the floor. The plaintiff claims she sustained severe injuries that resulted in pain and suffering, mental anguish, diminished ability to enjoy life and medical expenses. 

The plaintiff holds the defendants responsible because they allegedly failed to repair or replace the furled mat and to warn the plaintiff about the dangerous condition of the furled mat.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, pre- and post-judgment interest, costs and expenses for this action and other just and proper relief. She is represented by Shawn R. Romano of Romano & Associates PLLC in Beckley.
