HINTON – A Hinton resident employed as an iron worker alleges he was terminated because of his complaints about contaminants in the New River during a project.
Carmen McGuire filed a complaint on June 8 in the Summers Circuit Court against Heeter Geotechnical Construction LLC, Coastal Drilling East LLC and Shaft Drillers International LLC alleging wrongful discharge.
According to the complaint, the plaintiff began his employment with Heeter in 2014 on the Bluestone Dam Project in Hinton. He alleges that on July 29, 2016, he was terminated from his employment for repeatedly complaining about contaminants purportedly being discharged into the New River.
The plaintiff holds Heeter Geotechnical Construction LLC, Coastal Drilling East LLC and Shaft Drillers International LLC responsible because the defendants allegedly retaliated against him by demoting him from his position and by terminating his employment.
The plaintiff seeks judgment against defendants in such amount that will be determined by jury, plus cost, attorney's fees and interest. He is represented by Stephen P. New of Stephen P. New LC in Beckley and Mark A. Barney of Barney Law PLLC in Hurricane. The case has been assigned to Circuit Judge Robert A. Irons.
