Parent, son allege state agency allowed child to be molested

CHARLESTON — A parent and child are suing a West Virginia state agency, alleging deprivation of the child's constitutional rights.

A.H., individually and as parent and next friend of R.H., a minor, filed a complaint June 12 in Kanawha Circuit Court against the West Virginia Department of Health and Human Resources, alleging failure to provide a safe and non-violent environment.

According to the complaint, a result of the department's negligence, R.H. was subjected to illegal sexual conduct by Tina Elaine Roach. The plaintiffs say they have suffered emotional trauma, mental anguish, annoyance and inconvenience. 

The plaintiffs allege the defendant failed to protect R.H. by failing to adequately supervise the conduct of Roach.

The plaintiffs seek trial by jury, compensatory damages, pre- and post-judgment interest, attorney fees, court costs and all other just and proper relief. They are represented by attorney Greg A. Hewitt of Hewitt & Salvatore PLLC in Fayetteville.
