NEW CUMBERLAND — A mother and child are suing a Hancock County business, alleging negligence caused injuries to the son.
Zachary Bowen, a minor child and Carrie McKinney, as parent and legal guardian, filed a complaint June 19 in Hancock Circuit Court against Orran Hoffstetter Inc., doing business as Congo Corporation, and Jane and Jon Does, alleging they breached their duties to maintain the premises in a reasonably safe condition.
According to the complaint, on June 15, 2016, Zachary Bowen was injured when the roof of the Congo building at 1100 Collins Memorial Drive, Chester, collapsed, and caused him to fall 20 feet to the ground. The suit says Bowen has suffered mental distress and anxiety, permanent injuries, disability and medical expenses.
The plaintiffs alleges the defendants negligently allowed the area to be in a dangerous and hazardous condition and failed to secure the premises.
The plaintiffs seek trial by jury, compensatory and punitive damages, pre- and post-judgment interest, attorney fees and court costs and all other legal and proper relief.
