Hydraulics company alleges mining equipment provider owes more than $33,000

BECKLEY — A Beaver hydraulics company is suing a Beckley mining equipment provider, alleging breach of agreement and unjust enrichment.

WC Hydraulics LLC filed a complaint June 28 in Raleigh Circuit Court against Phillips Machine Service Inc.,  alleging failure to fulfill it obligations under a contract.

According to the complaint, between January and April 2017, WC Hydraulics delivered certain products to Phillips Machine on credit. The suit says total invoiced amount of $33,409.65 remains due and owing. 

The plaintiff alleges Phillips Machine has failed to timely pay the amounts due under the invoices.

WC Hydraulics seeks trial by jury, judgment of $33,409.65, pre- and post-judgment interest, court costs and attorney fees and all other equitable relief. It is represented by attorney Ramonda C. Lyons of Lewis Glasser Casey & Rollins PLLC in Charleston.
