CHARLESTON – A Charleston woman alleges that a collection agency is unlawfully attempt to collect a purported debt.
Theresa Jenkins filed a complaint on June 30 in the Kanawha Circuit Court against Charleston Area Medical Center Inc., doing business as Healthcare Financial Services, citing the West Virginia Collection Agency Act and the West Virginia Consumer Credit and Protection Act.
According to the complaint, the plaintiff alleges that the defendant does not have the authority to collect a debt it claims she owes because it is not licensed or bonded to conduct business as a debt collector in the state.
The plaintiff requests a trial by jury and seeks compensatory damages, statutory damages, punitive damages, interest, all legal fees and any other relief as the court deems just. She is represented by Troy N. Giatras of The Giatras Law Firm in Charleston. The case has been assigned by Circuit Court Judge James C. Stucky.
