WHEELING – An Ohio County woman alleges her loan servicer failed to apply a payment and now is unlawfully attempting to collect a debt.

Maureen Diloreti Vannest filed a complaint on July 3 in the Ohio Circuit Court against Nationstar Mortgage LLC alleging unfair debt collection.

According to the complaint, the plaintiff obtained a second mortgage in 2006 and the defendant later obtained the servicing rights on the loan. The suit states that in 2014 or 2015, the defendant failed to apply a monthly payment and began engaging in a campaign of unfair and abusive collection practices.

The plaintiff holds Nationstar Mortgage LLC responsible because the defendant allegedly misrepresented the true balance of the loan, failed to credit all payments upon receipt and communicated with plaintiff with such frequency meant to abuse or harass.

The plaintiff seeks judgment against defendant for all damages, penalties, interest, attorney's fees, and other relief the court deems just. She is represented by James G. Bordas and Jason E. Causey of Maureen Diloreti Vannest in Wheeling. The case has been assigned to Circuit Judge Ronald E. Wilson.
