LOGAN – Two Logan County employers are accused of terminating a man because of his age.

Earl Dotson filed a complaint July 19 in Logan Circuit Court against Blackhawk Mining LLC, Hampden Coal LLC and Tony Osbornes alleging violation of the West Virginia Human Rights Act.

According to the complaint, the plaintiff is in his 50s and worked for the defendants or their predecessors for 10 years. He alleges he was terminated in July 2015 and replaced with a younger employee.

The plaintiff holds Blackhawk Mining LLC, Hampden Coal LLC and Osborne responsible because the defendants allegedly terminated his employment because of his age.

The plaintiff seeks punitive damages, attorney's fees, costs and such other just and equitable relief. He is represented by Stephen P. New and Amanda J. Taylor in Beckley. The case has been assigned to Circuit Judge Joshua Butcher.
