Man alleges vehicle purchased from Mountaineer Automotive LLC had defects

CHARLESTON – A Logan County man alleges a vehicle he purchased was defective and that negligent repairs caused it to explode.

Robert "Bobby" Hicks and Fast Action Towing LLC filed a complaint July 11 in Kanawha Circuit Court against Mountaineer Automotive LLC, J & J Fabricating & Trailers Inc. and Mitsubishi Motors North America Inc. alleging negligence, breach of contract and other counts.

According to the complaint, the plaintiffs purchased a commercial vehicle from Mountaineer Automotive that they allege had defects that were not known at the time purchase. They allege they took the vehicle to J&J for repairs to the commercial gas tanks, which it alleged it fully repaired. The suit states the vehicle's gas tanks later caught fire and caused the vehicle to explode and completely burn.

The plaintiffs holds Mountaineer Automotive LLC, J & J Fabricating & Trailers Inc. and Mitsubishi Motors North America Inc. responsible because the defendants allegedly failed and refused to honor any warranties for the defects found on the vehicle purchased by the plaintiff and negligent made repairs to the vehicle.

The plaintiffs request a trial by jury and seek judgment against the defendant. They are represented by D. Adrian Hoosier II and Erica Lord of Lord Hoosier PLLC in Charleston. The case has been assigned to Circuit Judge Tod J. Kaufman.
