Bojangles' patron alleges elevation in sidewalk caused fall, injuries

HUNTINGTON – An Ohio woman claims she was injured at a Huntington restaurant.

Julie Huron filed a complaint July 24 in Cabell Circuit Court against Bojangles' International LLC, Bojangles' Restaurants Inc. and The Rutherford Group LLC alleging negligence.

According to the complaint, the plaintiff alleges that she visited the defendants' Huntington location on Sept. 25, 2016, and sustained physical injuries when she did not perceive the change in elevation from the sidewalk to the parking lot. 

The plaintiff holds Bojangles' International LLC, Bojangles' Restaurants Inc. and The Rutherford Group LLC responsible because the defendants allegedly failed to paint the evaluation change to warn customers and failed to keep and maintain the property in a reasonably safe condition.

The plaintiff requests a trial by jury and seeks judgment against the defendant for compensatory damages, medical expenses, court costs, general damages, interest and any further relief the court grants. She is represented by Salyer Law Office PLLC in Paintsville, Kentucky. The case has been assigned to Circuit Judge Paul T. Farrell.
