Huntington man says water line leak damaged property

HUNTINGTON – A Huntington property owner claims that a leaking water line damaged his residence.

James Goheen filed a complaint Aug. 8 in Cabell Circuit Court against American Water Works Service Co. Inc., doing business as West Virginia-American Water Co., alleging negligence.

According to the complaint, the plaintiff alleges that around Aug. 17, 2015, an unusual accumulation of water was noticed on his property and damaged his basement and a retaining wall. The suit states later testing and digging determined that the water was a result of a leak in the defendant's fresh water lines.

The plaintiff holds American Water Works Service Co. Inc. responsible because the defendant allegedly negligently allowed a leak to occur and failed to promptly address such leak.

The plaintiff seeks compensation for general and special damages, statutory interest, costs and attorney's fees and such other just and proper relief. He is represented by Thomas P. Boggs of Duffield, Lovejoy, Stemple & Boggs PLLC in Huntington. The case has been assigned to Circuit Judge Christopher Chiles.
