Norfolk Southern Railway employee seeks damages for knee, back injuries

PRINCETON – A Mercer County man alleges his employer's failure to provide safe and suitable tools led to his knee and back injuries.

George M. Walker filed a complaint Aug. 16 in Mercer Circuit Court against Norfolk Southern Railway Co. citing the Federal Employers' Liability Act.

According to the complaint, the plaintiff has been employed by the defendant since 1991 in various positions. He alleges he has suffered knee and back pain as a result of his employment.

The plaintiff holds Norfolk Southern Railway Co. responsible because the defendant allegedly required the plaintiff to work with equipment that put stress and strain on his spine and knees, failed to provide him with safe and properly functioning machinery and failed to provide him adequate rest periods during his shifts.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount that exceeds the jurisdiction of the court, interest, court costs and any further relief the court grants. He is represented by James F. Humphreys of James F. Humphreys & Associates LC in Charleston. The case has been assigned to Circuit Judge Derek C. Swope.
