Montana man alleges property was fraudulently transferred

PINEVILLE – A Montana man has filed a suit over the sale of a property in Wyoming County.

Dale Rife filed a complaint Aug. 25 in Wyoming Circuit Court against Thomas Hanna Evans PLLC, Thomas Hannah Evans, Margaret A. Shields, Michael Shields, Steve A. Rife, Timothy Mutters and Erma Mutters alleging professional negligence and other counts.

According to the complaint, the plaintiff owns a third interest in a property in Wyoming County with his siblings Margaret A. Shields and Steve A. Rife. The suit states in September 2014, the siblings filed a petition to partition real estate by their attorney Thomas Hanna Evans PLLC and Evans but personal service on the plaintiff was never completed.

The suit states that the plaintiff pursued litigation and while the matter was ongoing in the West Virginia Supreme Court of Appeals, his siblings sold the property to the Mutters in November 2015. The plaintiff alleges the deed was prepared and recorded by Evans and Thomas Hanna Evans PLLC and that this sale was not disclosed to the plaintiff or the court.

The plaintiff requests a trial by jury and seeks compensatory damages and other damages. He is represented by Dennie S. Morgan Jr. of Morgan Law in Welch. The case has been assigned to Circuit Judge Warren R. McGraw.
