Guest files suit against Charleston Area Medical Center after fall

CHARLESTON – A Kanawha County woman is seeking more than $75,000 in damages after falling in a health care facility's parking garage.

Dora Burcham filed a complaint Aug. 7 in Kanawha Circuit Court against Charleston Area Medical Center Inc. alleging negligence.

According to the complaint, the plaintiff was visiting the defendant's premises on June 16 and sustained serious physical injuries when she slipped and fell while walking in the parking garage.

The plaintiff holds Charleston Area Medical Center Inc. responsible because the defendant allegedly failed to warn the plaintiff regarding the condition and allowed the condition to develop.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount of more than $75,000 plus interest, court costs and any further relief the court deems just. She is represented by Robert B. Warner and Christopher Schumacher of Warner Law Offices PLLC in Charleston. The case has been assigned to Circuit Judge Charles E. King.
