Couple claims fraud event should be covered under Erie Insurance Co. policy

MARTINSVILLE – A Wetzel County couple alleges their insurer wrongfully denied their fraud claim.

John Haynes and Crystal Haynes filed a complaint on Sept. 1 in the Wetzel Circuit Court against Erie Insurance Co. alleging breach of contract.

According to the complaint, the plaintiffs allege that the suffered a direct financial loss of $30,000 because of a fraud event, which they allege is covered under their homeowner's insurance policy with the defendant.

The plaintiffs holds Erie Insurance Co. responsible because the defendant allegedly denied the plaintiffs' claim and failed to promptly provide a reasonable explanation of the basis of denial.

The plaintiffs request a trial by jury and seek all identity recovery coverage benefits due to the plaintiff, compensatory damages, general damages, punitive damages, all legal fees, interest and any other relief the court deems just. They are represented by Scott S. Blass and Jake R. Stout of Bordas & Bordas PLLC in Wheeling. The case has been assigned to Circuit Judge David W. Hummel Jr.
