Customer at Charleston Kroger alleges wet floor caused fall

By Philip Gonzales | Sep 28, 2017

CHARLESTON – A patron alleges she was injured at a grocery store in Charleston because of a slippery floor.

Latisha Mason filed a complaint Aug. 21 in Kanawha Circuit Court against Kroger Limited Partnership I alleging negligence.

According to the complaint, the plaintiff alleges that on July 29, she sustained multiple serious injuries when she slipped and fell on the wet floor in the produce section at defendant's Kroger store in Charleston.

The plaintiff holds Kroger Limited Partnership I responsible because the defendant allegedly failed to correct and remove the dangerous condition and failed to warn its patrons of the existence of such condition.

The plaintiff requests a trial by jury and seeks damages in an amount that will fairly compensate her for her damages, pre- and post-judgment interest, attorney's fees, costs and expenses and such other and further relief. She is represented by Robert B. Warner and Christopher Schumacher of Warner Law Offices PLLC in Charleston. The case has been assigned to James Stucky.
