C & M Courier Services alleged to owe more than $85,000 for loan

CHARLESTON – A Cross Lanes company is alleged to have defaulted on a loan.

IOU Financial Inc. filed a complaint Aug. 21 in Kanawha Circuit Court against The Cooke Co. LLC, doing business as C & M Courier Services, and Roy Lee Cooke alleging breach of contract.

According to the complaint, the plaintiff alleges that on May 6, 2016, The Cooke Co. executed a promissory note in favor of plaintiff in the amount of $101,728 with Cooke as guarantor. As a result of defendants' default in payment terms, to entire balance of $67,465.43 is immediately due and payable. 

The plaintiff seeks judgment against defendants in the amount of $85,008.61, costs of suit and all other relief to which it is entitled. It is represented by John R. Keating of Amato Keating and Lessa PC in Bethlehem, Pennsylvania. The case has been assigned to Circuit Judge Tod J. Kaufman.
