Woman alleges she was subjected to sexual harassment at Arch Coal

GRAFTON – A woman formerly employed by Arch Coal Inc. alleges she was forced to quit her job because of unchecked sexual harassment.

Jessica M. Rose filed a complaint Sept. 5 in Taylor Circuit Court against Arch Coal Inc., Michael Snyder and David Dean citing the West Virginia Human Rights Act.

According to the complaint, the plaintiff was hired as warehouse technician in 2013 for the defendant. She alleges she was repeatedly sexually harassed from co-workers and that reporting the harassment had no effect. The suit states she was forced to quit in July 2017 because of the hostile work environment.

The plaintiff requests a trial by jury and seeks damages, lost wages, benefits, back pay, front pay, damages for indignity, embarrassment, humiliation, annoyance and emotional distress, punitive damages, interest, all legal fees and any other relief as the court deems just. She is represented by Rodney A. Smith and Todd S. Bailess of Bailess Smith PLLC in Charleston.
