Wayne woman says she fell at Walmart because of spilled milk

WAYNE – A Wayne woman alleges that she was injured while shopping in a Walmart store because of spilled milk.

Dale Ellis filed a complaint Sept. 8 in Wayne Circuit Court against Wal-Mart Stores Inc. alleging that the retail stores operator failed to maintain its premises in a reasonably safe condition.

According to the complaint, the plaintiff alleges that on Sept. 8, she injured her right knee when she slipped and fell on milk while shopping at defendant's Walmart store at 100 McGinnis Drive. She alleges she has suffered pain and suffering, medical expenses, annoyance, aggravation and inconvenience. 

The plaintiff holds Wal-Mart Stores Inc. responsible because the defendant's employees allegedly failed to promptly clean up the milk that spilled on the floor and failed to place warning signs around the area.

The plaintiff requests a trial by jury and seeks damages in excess of the jurisdictional limits of the court, pre- and post-judgment interest and all issues triable by jury. She is represented by Donald R. Jarrell of Law Offices of Donald R. Jarrell in Wayne. The case has been assigned to Circuit Judge James H. Young Jr.
