Man seeks damages after ResCare resident allegedly struck him with bowling ball

BECKLEY – A Raleigh County man alleges he suffered a fractured skull and brain injury when he was struck in the head by a bowling ball.

Mitchell Carte filed a complaint Sept. 21 in Raleigh Circuit Court against ResCare Inc., Casi Noble, Logan Thomas Gentry and John/Jane Doe alleging negligence.

According to the complaint, Gentry is a mentally disabled, full-time resident at ResCare in Beckley and Noble is an employee of ResCare charged with supervising him. The plaintiff alleges Noble and Gentry were at Leisure Lanes in Beckley on in Dec. 9, 2015, and that Gentry struck the plaintiff in the head with a bowling ball, which knocked him unconscious. 

The plaintiff holds ResCare Inc., Noble, Gentry and John/Jane Doe responsible because ResCare and Noble failed to properly supervise Gentry.

The plaintiff requests a trial by jury and seeks judgment against the defendants for compensatory and punitive damages, interest, court costs and any further relief the court grants. He is represented by Paul M. Stroebel of Stroebel & Johnson PLLC in Charleston. The case has been assigned to Circuit Judge Andrew Dimlich.
