Former employee accuses hospital operator of wrongful termination

CHARLESTON — A former employee is suing a Kanawha County hospital operator, alleging a hostile work environment, retaliation and wrongful or constructive eviction.

Darlene Duncan filed a complaint Sept. 27 in Kanawha Circuit Court against CAMC Health System Inc., alleging violation of the West Virginia Human Rights Act.

According to the complaint, on March 28, 2015, Duncan sustained severe and permanent on-the-job injuries to her knee due to a malfunctioning door. The suit says the injury deemed her a disabled person. 

As a result of defendant's actions, the suit says, Duncan has suffered lost wages and benefits, indignity, emotional distress and humiliation. The plaintiff alleges the defendant refused to provide reasonable accommodation for Duncan, retaliated against her and treated her so badly that she was forced to resign.

Duncan seeks trial by jury, all damages, attorney fees, court costs, pre- and post-judgment interest and all other just and reasonable relief. She is represented by attorney Erica Lord of Lord Hoosier PLLC in Charleston.
