Customer accuses Honda dealer of fraud

BECKLEY — A Raleigh County woman is suing a Honda dealer and creditor, alleging negligence, misrepresentation and manipulation.

BECKLEY — A Raleigh County woman is suing a Honda dealer and creditor, alleging negligence, misrepresentation and manipulation.

Rebecca Morgan filed a complaint Sept. 29 in Raleigh Circuit Court against H & P Inc., doing business as John Howerton Honda and Santander Consumer USA Inc., alleging they conspired to commit tortious actions or omissions.

According to the complaint, as a result of the defendants' wrongful conduct, Morgan was obligated to pay a higher monthly installment for a Nissan Altima she purchased from the defendants. The suit says after realizing that she couldn't afford to continue the monthly installments, Morgan surrendered the vehicle and was repossessed by Santander 

Morgan alleges she has suffered annoyance, inconvenience, loss of self esteem and damage to credit. The plaintiff alleges the defendants represented her income to be three times higher than the actual amount and hurriedly executed the sales documents to conceal the true costs of the transaction.

Morgan seeks trial by jury, compensatory and punitive damages with penalties, interest, attorney fees, court costs and expenses and all further relief the court deems necessary and appropriate. She is represented by attorney Paul W. Roop II of Roop Law Office LC in Beckley.
