Customer blames Ollie's Bargain Outlet for injuries

BECKLEY — A Raleigh County man is suing an outlet owner, alleging negligence and premises liability led to injuries for the plaintiff.

Robert Kennedy filed a complaint Sept. 29 in Raleigh Circuit Court against Ollie's Bargain Outlet Inc. of Harrisburg, Pennsylvania, alleging failure to maintain its property in a reasonably safe condition.

According to the complaint, on Oct. 24, 2015, Kennedy was walking down the aisle inside the defendant's building at 126 New River Drive in Beckley. The suit says one or more small appliance boxes fell onto Kennedy's head and body, resulting in severe injuries, medical expenses, physical and mental pain, lost wages and inconvenience. 

The plaintiff alleges Ollie's Bargain Outlet negligently failed to properly support its merchandise with appropriate shelving materials.

Kennedy seeks trial by jury, compensatory damages, plus interest, attorney fees, court costs and expenses and all other relief the court deems just and proper.
