Kentucky woman seeks payment of long-term disability benefits after her claim was denied

HUNTINGTON – A Kentucky woman alleges she is disabled according to the terms of a plan and that her benefits were wrongfully denied.

Linda Farley filed a complaint Oct. 5 in U.S. District Court for the Southern District of West Virginia Huntington Division against King's Daughter's Medical Center Long Term Disability Class 1, Liberty Life Assurance Co. of Boston and Does 1-5 alleging that they violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that on July 19, 2016, she stopped receiving her long-term disability benefits from the defendants. The suit states the plaintiff has appealed the defendants' decision to deny disability benefits multiple times from 2013 to 2017. 

The plaintiff holds King's Daughter's Medical Center Long Term Disability Class 1, Liberty Life Assurance Co. of Boston and Does 1-5 responsible because the defendants allegedly disregarded her treating physician's opinion and denied and refused to continue paying his benefits due under the long-term disability plan.

The plaintiff seeks an order directing defendants to pay all her benefits due under the plan, award for money judgment owed to plaintiff, interest, attorney's fees, costs and such other just and proper relief. She is represented by J. Patrick L. Stephens of Underwood Law Offices in Huntington.
