Moundsville couple claims insurer failed to pay underinsured motorist benefits

MOUNDSVILLE – A Moundsville couple allege their insurer has refused to pay underinsured motorist benefits to them after they were injured in a collision.

Susan Noble and David Noble filed a complaint Oct. 6 in Marshall Circuit Court against Metropolitan Direct Proper and Casualty Insurance Co. alleging breach of contract.

According to the complaint, the plaintiffs allege that on Sept. 29, 2016, Susan Noble and David Noble suffered physical injuries and damages due to a vehicle accident negligently caused by Ethan Springer, an underinsured motorist. They allege they are entitled to the underinsured motorist coverage pursuant to the terms of the insurance policy issued by defendant and that the defendant has refused to pay the benefits. 

The plaintiffs request a trial by jury and seek judgment against defendant for all benefits due to them, pre- and post-judgment interest and such other just and proper relief. They are represented by Scott S. Blass and John E. Artimez Jr. of Bordas & Bordas PLLC in Wheeling. The case has been assigned to Circuit Judge David W. Hummel Jr.
