Beckley couple claims truck doesn't conform to warranties, GM failed to replace it

BECKLEY – A Beckley couple alleges that a Chevrolet truck they purchased does not conform to its new motor vehicle warranties.

Michael C. Davis and Teresa K. Davis filed a complaint Oct. 10 in Raleigh Circuit Court against General Motors LLC alleging that the automobile manufacturer repeatedly violated its obligations under Chapter 46A of the West Virginia Code.

According to the complaint, the plaintiffs allege that on May 12, 2016, they purchased a new 2016 Chevrolet Truck Silverado for $40,925 from defendant's dealer. After purchase, they allege they experienced repeated nonconformities with the motor vehicle, which substantially impaired its use, value and safe. 

The plaintiffs hold General Motors LLC responsible because the defendant allegedly failed to conform the vehicle to the warranties and refused to replace it with a comparable new motor vehicle.

The plaintiffs request a trial by jury and seek revocation of acceptance and refund of purchase price, costs, expenses, attorney's fees and any further relief that the court may deem appropriate. They are represented by Anthony M. Salvatore of Hewitt & Salvatore PLLC in Fayetteville. The case has been assigned to Circuit Judge Robert A. Burnside Jr.
