White Armature Works seeks nearly $150,000 from Indiana company

LOGAN – A Mallory company alleges it provided goods to an Indiana company and that it is still owed for them.

White Armature Works Inc. filed a complaint Oct. 13 in Logan Circuit Court against McCoy Elkhorn Coal LLC alleging that the mining operators failed to perform its contractual obligations.

According to the complaint, the plaintiff alleges that it provided defendant with materials relating to electronic motors used in the coal industry. To date, the outstanding balance of $297,942.50 allegedly remains due and owing. 

The plaintiff holds McCoy Elkhorn Coal LLC responsible because the defendant allegedly failed and refused to make payments for the said amount.

The plaintiff requests a trial by jury and seeks damages in the amount of $297,942.50, prejudgment interest, costs, attorney's fees and such other and further relief. It is represented by Daniel T. Yon and Ralph J. Hagy of Bailes Craig & Yon PLLC in Huntington. The case has been assigned to Circuit Judge Joshua Butcher.
