Widower alleges Metropolitan Life Insurance Co. unlawfully refused to pay benefits

FAYETTEVILLE – An Oak Hill widower alleges an insurance company wrongfully denied him life insurance benefits.

Charles Allen, individually and as an estate representative of Shirley Allen, filed a complaint Oct. 25 in Fayette Circuit Court against Metropolitan Life Insurance Co. alleging that the licensed insurer failed to perform its obligations under the contract.

According to the complaint, the plaintiff alleges that upon the passing of his wife Shirley Allen, he timely filed a claim for the benefits under the life insurance policy issued by defendant. The suit states the defendant denied the claim June 5.

The plaintiff holds Metropolitan Life Insurance Co. responsible because the defendant's refusal to provide benefits allegedly breached the insurance contract.

The plaintiff seeks compensatory and punitive damages as justified by evidence. He is represented by Greg A. Hewitt of Hewitt & Salvatore PLLC in Fayetteville. The case has been assigned to Circuit Judge Paul M. Blake Jr.
