Princeton widow seeks damages from doctor after husband's death

PRINCETON – A widow has filed suit against a physician after her husband died after a surgery.

Rita J. Thompson, personal representative for the estate of Paul Jay Thompson Jr., filed a complaint Nov. 6 in Mercer Circuit Court against Marshal T. Gwynn DPM alleging negligence.

According to the complaint, the defendant performed foot surgery on Paul Jay Thompson Jr. on April 10. The suit states the decedent died the next day after his heart rate dropped after a tourniquet was removed. The suit states that before the tourniquet was removed, the defendant injected the decedent with Marcaine without waiting for it to be absorbed by the decedent's tissues, which led to local anesthetic systemic toxicity.

The plaintiff holds Gwynn responsible because the defendant allegedly failed to properly diagnose Paul Jay Thompson Jr.'s condition and failed to conduct tests and examinations of him.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount that will fairly compensate the plaintiff for their damages, punitive damages, court costs and any further relief the court grants. She is represented by J. Timothy DiPiero, Lonnie C. Simmons and Robert M. Bastress III of Ditrapano, Barrett, Dipiero, McGinley & Simmons PLLC in Charleston. The case has been assigned to Circuit Judge William J. Sadler.
