NEW MARTINSVILLE – The children of a woman treated by a New Martinsville physician are seeking damages following her death.
Robert Morris, Ressa Jackson and Julia Morris, as co-executors of the estate of Marilyn Morris, filed a complaint Nov. 2 in Wetzel Circuit Court against Bill Apostolon DO, Wetzel County Hospital Emergency Department and Wetzel County Hospital Association citing the West Virginia Wrongful Death Act.
According to the complaint, the plaintiffs allege that on Sept. 23, 2016, Marilyn Morris was presented at defendant Wetzel County Hospital with complaints of throat constriction sensation and blood pressure of 179/97. Shortly after being discharged by Apostolon the same day, the suit states she collapsed at home in cardiac arrest and died.
The plaintiffs holds Apostolon, Wetzel County Hospital Emergency Department and Wetzel County Hospital Association responsible because the defendants allegedly negligently failed to admit decedent to the hospital and discharge her without providing cardiac workup, chest X-ray, EKG and cardiac enzyme test.
The plaintiffs request a trial by jury and seek damages in an amount that will fairly and reasonably compensate the beneficiaries of Marilyn Morris, costs, expenses and fees incurred for this action and such other relief that are proper. They are represented by Geoffrey Brown of Bordas & Bordas PLLC in Wheeling. The case has been assigned to Circuit Judge Jeffrey Cramer.
