CHARLESTON – A lawyer whose office is in Chase Tower in Charleston alleges she was injured because of issues with the building's elevator.
Pamela C. Deem filed a complaint Nov. 9 in Kanawha Circuit Court against NG 701 Virginia Street LLC, Nightingale Realty LLC and Thyssenkrupp Elevator Corp. alleging negligence.
According to the complaint, the plaintiff alleges that on Nov. 12, 2015, she was stepping into one of the elevators in Chase Tower when the elevator dropped several inches and caused her to fall. She alleges she suffered significant injuries resulting in medical expenses.
The suit states NG 701 Virginia Street LLC owned Chase Tower, Nightingale managed the building and Thyssenkrupp held the maintenance agreement for the elevator.
The plaintiff holds NG 701 Virginia Street LLC. Nightingale Realty LLC and Thyssenkrupp Elevator Corp. responsible because the defendants allegedly failed to ensure that the elevators were working properly.
The plaintiff requests a trial by jury and seeks special and general damages, attorney's fees, costs and any further relief as the court may deem just and proper. She is represented by John A. Kessler and David R. Pogue of Carey, Scott, Douglas & Kessler PLLC in Charleston. The case has been assigned to Circuit Judge Jennifer Bailey.
