Consumer seeks rescission of vehicle purchase from FCA US

KINGWOOD – A Morgantown consumer claims a vehicle he purchased has warranty nonconformities that have impaired the use and value of the vehicle.

Brandon Myers filed a complaint Nov. 15 in Preston Circuit Court against FCA US LLC alleging that the automobile dealer violated the Magnuson-Moss Warranty Improvement Act.

According to the complaint, the plaintiff alleges that on July 12, 2016, he purchased a used 2015 Ram 3500 manufactured and warranted by the defendant for more than $54,762.74. After purchase, he claims he experienced serious defects with the vehicle that substantially impaired its use, value and safety. The plaintiff states that repair attempts were ineffective.

The plaintiff holds FCA US LLC responsible because the defendant allegedly failed to deliver the vehicle that was fit for its intended use and failed to conform the same with its warranties.

The plaintiff requests a trial by jury and seeks rescission or revocation of acceptance, award for all damages, pre- and post-judgment interest and such other general and special relief. He is represented by Christina Gill Roseman of Roseman Law Firm PLLC in Pittsburgh, Pennsylvania. The case has been assigned to Circuit Judge Lawrance S. Miller Jr.
