Bert Wolfe Inc. service mechanic alleges he was not paid in timely manner for warranty work

CHARLESTON – A Kanawha County man alleges his auto dealer employer failed to pay him in a timely manner for certain work performed.

Keith Groves, individually and on behalf of all others similarly situated, filed a complaint in Kanawha Circuit Court against Bert Wolfe Inc. alleging that the automobile dealer violated the West Virginia Wage Payment and Collection Act.

According to the complaint, the plaintiff began his employment with the defendant in 2014 as a service mechanic. He alleges that the defendant failed to timely pay him for the warranty work he performed on customers' vehicles.

The plaintiff requests a trial by jury and seeks an order certifying this action as a class action and appointing plaintiff and his counsel as representatives, award for punitive damages, attorney's fees, costs and any other relief that may be just and equitable. He is represented by W. Stewart Calwell and David H. Carriger of The Calwell Practice LC in Charleston and D. Adrian Hossier II of Lord Hoosier PLLC in Charleston. The case has been assigned to Circuit Judge Carrie L. Webster.
