WAYNE – A Danville woman alleges her minor son was assaulted while under the care of a facility.

Kimberly L. Noll, as mother and next friend of Seth Blevins, a minor filed a complaint in Wayne Circuit Court against Stepping Stones Inc., Susan Fry, et al. alleging professional malpractice and negligence and other counts.

According to the complaint, Blevins was placed at Stepping Stones Inc. because of truancy issues in October 2016. The plaintiff alleges that while at the facility, Blevins was a victim of assault and battery twice by other residents.

The plaintiff holds Stepping Stones Inc., Fry, et al. responsible because the defendants allegedly failed to provide Blevins a safe and nurturing residence and failed to monitor the residents of Stepping Stones.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages, attorney's fees, costs, pre- and post-judgment interest and such other relief as justice may require. She is represented by Jon D. Hoover of Hoover Andrews PLLC in Barboursville and Jason D. Harwood of Harwood Legal PLLC in Logan.
