Modern Home Concepts Inc. alleged to owe more than $12,000 for goods purchased

WINFIELD – A Hurricane company is alleged to have failed to pay for goods purchased on credit.

Ferguson Enterprises Inc. filed a complaint on Jan. 16 in Putnam Circuit Court against Modern Home Concepts Inc. and Dale Oxley alleging breach of contract and other counts.

According to the complaint, the plaintiff alleges that beginning in February 2010, it sold certain goods to defendants on credit. After allowances for all proper credits for payments and/or returned merchandise, the amount of $16,195.31 allegedly remains due and owing to the plaintiff. 

The plaintiff holds Modern Home Concepts Inc. and Oxley responsible because despite demands for payments, the defendants allegedly failed and refused to make payments for the balance herein mentioned.

The plaintiff seeks judgment against the defendants for $12,956.25 together with interest and attorney's fees of $3,239.06, costs of court and all other relief to which plaintiff is entitled. It is represented by John R. Keating of Amato Keating and Lessa PC in Bethlehem, Pennsylvania.
