CHARLESTON – A Kanawha County woman alleges that her private medical information was disclosed to third parties without her permission by a staff member of a Charleston medical facility.
Jodi Morgan filed a complaint in Kanawha Circuit Court against Charleston Area Medical Center Inc., doing business as CAMC Women and Children's Hospital, alleging negligence, invasion of privacy and other counts.
According to the complaint, the plaintiff alleges that on Feb. 7, 2017, she received medical services at CAMC Women and Children's Hospital. She alleges that during her stay, one of the defendant's staff members notified third parties of her medical diagnosis without her authorization.
The plaintiff holds Charleston Area Medical Center Inc. responsible because the defendant allegedly breached its duties to ensure the confidentiality and protect the privacy of her medical and personal information.
The plaintiff requests a trial by jury and seeks all damages, pre- and post-judgment interest, attorney's fees costs and such other fair and proper relief. She is represented by Hoyt Glazer of Law Office of Hoyt Glazer PLLC in Huntington. The case has been assigned to Circuit Judge Charles King.
