MORGANTOWN – A Pennsylvania couple is seeking damages after the husband was injured while painting at a Morgantown property.

Edward Richard Rump and Tammy Clement filed a complaint Jan. 26 in Monongalia Circuit Court against Edward Wozniak, McLauglin Total Services Inc., et al. alleging negligence.

According to the complaint, the plaintiffs allege that on Jan. 30, 2016, Edward Rump was employed by defendant Wozniak and was tasked to paint the interior of a property located at University Park in Morgantown. He alleges he fell 14 feet when the scaffolding he was using shifted and caused him to fall. The suit states he sustained serious personal injuries and was caused to suffer pain, disability, lost wages, disfigurement and medical care and treatment expenses.

The plaintiffs holds Wozniak, McLauglin Total Services Inc., et al. responsible because the defendants allegedly failed to provide a safe equipment to do his task and failed to ensure that the scaffolding was functioning properly.

The plaintiffs request a trial by jury and seek damages in an amount that will fully compensate them, costs of court and such other just and appropriate relief. They are represented by Mark E. Gaydos and Woodrow E. Turner of McNeer, Highland, McMunn and Varner LC in Kingwood and Katie A. Killion and George Kontos of Kontos Mengine Law Group in Pittsburgh, Pennsylvania.
