HUNTINGTON — A costumer are suing Kroger Limited Partnership I, The Kroger Co., et al, grocery store operators, citing alleged insufficient measures were taken to prevent injuries.
Kathy Cline and Timothy Cline filed a complaint Feb. 2 in Cabell Circuit Court against the defendants alleging that they breached their duties to ensure their costumers safety.
According to the complaint, the plaintiffs allege that, in Feb. 6, 2016, Kathy Cline and Timothy Cline were lawfully upon defendants' grocery store when Kathy Cline was injured when she tripped over a package of kindling wood on the walkway. She sustained serious and permanent injuries that resulted in pain and suffering, medical and hospital expenses, mental anguish and emotional trauma. The plaintiffs holds Kroger Limited Partnership I, The Kroger Co., et al responsible because the defendants allegedly negligently allowed the walkway to remain in a dangerous condition without providing any warning and without taking corrective actions.
The plaintiffs request a trial by jury and seek damages in excess of the jurisdictional limits of the court, with interest, attorney's fees and costs. They are represented by Matthew P. Stapleton of Stapleton Law Offices in Huntington.
