Fayette Co. woman alleges Toyota sold defective vehicle

BECKLEY — A Fayette County consumer is suing Toyota, alleging breach of warranty.

Goldie Jane Moore filed a complaint March 1 in Raleigh Circuit Court against Toyota Motor North America Inc. and Toyota Motor Sales USA Inc., alleging they repeatedly and willfully violated Chapter 46A of the West Virginia Code.

According to the complaint, on April 19, 2017, Moore purchased a new 2017 Toyota Rav4 from defendants' authorized dealer in Raleigh County. After purchase, Moore says she repeatedly experienced life-threatening non-conformities with the vehicle warranty that substantially impaired its use, value and safety. 

As a result, the suit says Moore suffered annoyance, inconvenience and other consequential damages. The plaintiff alleges the defendants failed to conform the vehicle with its warranties after numerous attempts.

Moore seeks trial by jury, revocation of acceptance and refund of the purchase price, costs of repairs, compensatory damages, litigation costs and all further relief the court deems appropriate. She is represented by attorney Anthony M. Salvatore of Hewitt & Salvatore PLLC in Fayetteville.
