Customer blames New Martinsville restaurant owners for injuries

NEW MARTINSVILLE  — A customer is suing a New Martinsville restaurant owner, alleging negligence led to the plaintiff sustaining injuries.

Roseanne Ziefle filed a complaint March 3 in Wetzel Circuit Court against Choo-Choo's LLC, alleging failure to keep the premises reasonably safe for the plaintiff.

According to the complaint, on June 3, 2016, Ziefle was at at Choo-Choo's on Vine Street in New Martinsville when she sustained physical injuries, mental pain and suffering after she fell from the stairs when she caught her shoe. 

The plaintiff alleges Choo-Choo's failed to properly design their stairs in not having treads and no center handrail.

Ziefle seeks trial by jury, judgment that exceeds the jurisdictional limits of this court, interest and all further relief this court grants. She is represented by attorney Donald J. Tennant, Jr. of Tennant Law Offices in Wheeling.
