CHARLESTON — A Kanawha County man is suing General Motors and a used automobile dealer, alleging false pretenses and fraudulent concealment.
Samuel McKinney filed a complaint on March 9 in Kanawha Circuit Court against General Motors and Randal Sigman, who is doing business as Freedom Used Cars,alleging that they negligently sold vehicles that contain unreasonably dangerous condition.
According to the complaint, the plaintiff alleges that, on Aug. 8, 2016, he was driving a 2002 Chevrolet Monte Carlo, which he purchased from defendant Sigman when the instrument panel of the vehicle lit up, causing him to fight with the steering wheel before it spun and crash into the concrete median.
McKinney claims he suffered injuries to his neck. The plaintiff holds the defendants responsible because they allegedly failed to disclose the vehicle's defective ignition switch.
The plaintiff requests a trial by jury and seeks an order finding that the vehicle's ignition switches was defective, award for all damages, pre- and post-judgment interest, attorney's fees and such other and further relief.
