HUNTINGTON — A former inmate is suing Cabell County jail operators, alleging false imprisonment, battery and unlawful use of excessive force.
Tammy Taylor Fox filed a complaint in Cabell Circuit Court against The West Virginia Regional Jail and Correctional Facility Authority and John Does 1-5, alleging they violated the Eighth and Ninth Amendments to the U.S. Constitution.
According to the complaint, while Taylor was incarcerated at Western Regional Jail in Cabell County for a first-time DUI arrest, starting Nov. 5, 2017, and up to her release, the defendants forced her to strip nude in front of male officers. Due to that, the suit says, Fox suffered extreme emotional distress and severe injuries that resulted in multiple days of hospitalization.
The plaintiff alleges the defendants intentionally and excessively used force to strip her nude while strapped to a chair and for the duration of her incarceration.
Fox seeks trial by jury, judgment in an amount that will fully compensate her for her damages, pre- and post-judgment interest, attorney fees and all other relief to be determined by the jury. She is represented by attorneys Jason Goad and Scott McClure of McClure Goad PLLC in Huntington.
