CHARLESTON — Two Logan County customers are suing used car dealers, alleging misrepresentation.
Jeremy Johnson and Jamie Johnson filed a complaint in Kanawha Circuit Court against FCA US LLC, Thornhill Superstore Inc. and Santander Consumer USA Inc., alleging violation of the West Virginia Consumer Credit and Protection Act and the Uniform Commercial Code.
According to the complaint, on Dec. 26, 2012, the Johnsons entered into a contract with defendants to purchase a 2015 Chrysler 200. After purchase, the suit says the Johnsons experienced non-conformities with the vehicle. As a result, they say they suffered monetary loss, loss of use of the vehicle, emotional distress and inconvenience.
The Johnsons say they also were charged $1,918.60 for an "extended warranty."
The plaintiffs allege FCA US, Thornhill Superstore. and Santander Consumer USA fraudulently misrepresented the history and condition of the vehicle at the time of sale and refused to cancel the sales contract or to remedy the problems.
The Johnsons seek trial by jury, cancellation of the sales contract or revocation of acceptance, damages, attorney fees, court costs and all further relief the court deems appropriate.
