Father alleges he was negligently accused of sexual abuse by DHHR, others

MOUNDSVILLE — A Marshall County man is suing government agencies, alleging defamation and intentional infliction of emotional distress.

Charles Paris Brumfield filed a complaint May 1 in Marshall Circuit Court against the West Virginia Department of Health and Human Resources, Lighthouse Child Advocacy Center, Melinda Brumfield, the West Virginia Regional Jail and Correctional Authority et al. alleging the defendants continued to pursue litigation against him despite knowing the evidence was false and fictitious.

According to the complaint, Brumfield's former wife Melinda took two of his minor children to the defendants' child center to be interviewed regarding purported sexually abuse allegedly committed by the plaintiff. 

Charles Brumfield alleges the defendants continued an abuse and neglect proceeding despite Brumfield having had no contact with his children. He says the defendants knew all the evidence and fictitious and false. 

The plaintiff alleges the defendants filed sworn documents with the knowledge that all the evidence is false and also permitted unqualified and untrained employees to conduct forensic interviews involving allegations of child sexual abuse or negligence, causing Brumfield's reputation to be damaged.

Charles Brumfield seeks trial by jury, compensation for injuries, losses and damages, plus attorney fees, court costs, pre- and post-judgment interest, and all other relief deemed just, fair and equitable. He is represented by attorney Kevin L. Neiswonger of Neiswonger and White in Mounsville.
