Law firm sued for alleged malpractice, breach of contract

CHARLESTON — Raleigh County residents are suing Reginald D. Henry, Attorney at Law PLLC, Johnstone & Gabhart LLP and does 1-10, law firms, citing alleged attorney malpractice and breach of contract.

Bransom Williams and Della Williams filed a complaint on Aug. 13, in the Kanawha Circuit Court against the defendants alleging that they failed to file a timely administrative claim in Alpha Natural Resources Inc et al case.

According to the complaint, the plaintiffs allege that, between April 2016 and June 14, 2017, Bransom Williams retained Attorney Henry to represent him in his Social Security Claim and Worker's Compensation Claim and Johnstone & Gabhart LLP for his tort claims. Unfortunately, the defendants failed to file an administrative claim on behalf of Branson Williams. The plaintiffs hold Reginald D. Henry, Attorney at Law PLLC, Johnstone & Gabhart LLP and does 1-10 responsible because the defendants allegedly neglected its reasonable duties to plaintiff.

The plaintiffs request a trial by jury and seek general and special damages consequential damages, punitive damages, pre-judgment interest, and attorney's fees. They are represented by J. Patrick L. Stephens of Underwood Law Offices in Huntington.
